Zmitser Zhaleznichenka stays in army 3

The court of the Savetski district of Homel upheld the decision of the draft commission on calling for military service Zmitser Zhaleznichenka, activist of the Belarusian Popular Front party.

Zmitser Zhaleznichenka, deputy head of the region organisation “BPF Youth” was expelled from F. Skaryna Homel State University two times. He showed good academic results and didn’t miss classes without good excuse. The activist appealed against his first expelling to the court and won the trial. But after four days he was expelled again and drafted for army.

Yury Zhorau, judge of the court of the Savetski district of Homel, satisfied the claim of the guy’s parents on 8 February and suspended the decision of the military commission on draft Zmitser Zhaleznichenka for army. The activist was in the military unit in Zhlobin at that time.

Young soldiers took military oath on 9 February. But Zmitser Zhaleznichenka knew about the court decision and refused to swear military oath.

But it has been found out today at the trial, judge Yury Zhorau recalled his judgement yet on 8 February in view of “new facts.” It wasn’t said in the court what the facts were. A doctor, who examined the young man before the draft, was a witness. He said the diagnosis (hypertension, which gave defer to the young man) was wrong.

“What can I say – everything is clear. Zmitser needs to keep to special diet. I don’t know whether it is possible in a military unit,” activisst’s mother Ala Zhaleznichenka commented on the court judgement.

Lawyer of the guy is going to appeal against the decision of the Savetski district court, and file a complaint to the Centrals Court against unlawful Zmitser’s expel from university.
