Has Lukashenka sworn in already?

Dismissal of the government and appointment of the new composition of the Council of Ministers give grounds for hazarding two conjectures: either Lukashenka has already sworn in, having become a president for the 4th time, or has he run amok ignoring procedural requirements of the Belarusian law.

According to the Constitution of Belarus (Article 83) the candidate who had won the election only after taking an oath, as a result of which the presidential powers of the previous president expire, AFN reports.

Only after the oath is taken (swearing-in ceremony) the government abdicates, and the new president then appoints a new government, having agreed upon the choice of prime minister with the parliament beforehand.

As long as the government resigned yesterday, December 27 2010, and the Central Election Commission of Belarus announced the official results of the election last Friday, December 24 2010, Lukashenka was to swear in in the period from December 25 through December 27. However this event was missed in the life of the country, if it had occured at all.

“The oath is taken in a solemn ceremony in presence of deputies of the Chamber of representatives and members of the Council of Republic, judges of the Constitutional, Supreme and Supreme Economic Court…” the Constitution reads.

In this connection it is possible that Lukashenka was in such a hurry to change the government and secure his power as the 4th president being guided by some personal considerations, and he simply disregarded the Constitution of the country. Or he had simply run amok, demonstrating the whole world his impunity and disrespect to the law.
