Granit will pay indemnity to trade union activist

Court of Luniniec district partly satisfied the claim for a compensation for moral damage to an independent trade union’s activist.

A charter97.org’s correspondent reports that a former excavator driver at Granit enterprise Leanid Dubanosau appealed to court seeking for moral damage indemnity. He worked for the enterprise for almost 25 years. In whole this time there were no reprimands addressed to Dubanosau on the part of the employer, until Leanid became a member of the independent trade union’s primary organization in late 2011. Since then, according to the worker, he underwent repressions on the part of state authorities and enterprise’s administration. As a result, they decided to get rid of the obstinate excavator driver at Granit, having announced that his labour contract will not be prolonged.

However, Leanid Dubanosau told that the administration grossly violated the established order as they fired him. According to the legislation, the employer must notify the employee of their intents to stop labour relations no later than 1 month before the expiration of the contract in the written form. At the same time Dubanosau did not get a written warning of the coming non-prolongation of the contract. This was the reason for court proceedings. Leanid demanded Granit to pay him 7 million roubles as an indemnity for moral damage.

The case was considered by the chairman of Luniniec district court Mikhail Dzianisavich, who had already dealt with court appeals concerning other Granit’s trade union activists.

Inn all the cases Dzianisavich’s verdict was in favor of the enterprise, that is why Leanid Dubanosau appealed for the disqualification of the judge, since he doubted his impartiality. Nevertheless, the chairman of Luniniec district court denied the appeal of the disqualification of himself. As a result the case’s consideration he decided to partly satisfy the claim: Granit’s administration must pay Dubanosau 1 million roubles as an indemnity for the moral damage, caused by the violation of the dismissal procedure.
