Belsat TV wins over BELSATplus

The Supreme Court of Belarus dismissed the claim of BELSATplus.

The Board of the Supreme Court of Belarus dismissed the lawsuit of Andrei Beliakou, the director of private company BELSATplus against SA TVP, the founder of Belsat TV, the press service of the Belarusian Association of Journalists reports.

The court decided that Beliakou didn't give proofs of infringing the trademark Belsat in Belarus.

The decision comes into force and is not subject to appeal in the cassation procedure, only in the review procedure.

Mikail Yanchuk, Belsat's representative in Belarus, agrees with the court's ruling. Andrei Beliakou doesn't give comments.

BELSATplus company sued the television channel Belsat. Owner of the Belarusian company Andrei Beliakou claimed the TV channel was using the trademark illegally.

Beliakou's company sells satellite and cable TV equipment and radio equipment. It was founded by Siarhei Lysiankou in 2003 under the name Hightech Market. In May 2006, the new TV channel was known to be working under the name Belsat TV. A month later, the owner of Hightech Market, Siarhei Lysiankou, sold the trademark to Andrei Beliakou, who renamed the company as BELSATplus. The word “TV” appeared in the company's specifications in relation to cable television.

Belsat TV notes the channel and the domain name are registered in Poland. The domain name is neither registered nor administered from Belarus. The channel doesn't broadcast from Belarus as well, so the trademark lies beyond the jurisdiction of the Belarusian law, the TV channel says. Moreover, the TV channel's name was registered as Belsat TV, while the Belarusian private trade company has the name BELSATplus (registration certificate No. 190991566).
