Policeman to 12-year-old girl: “You are guilty, as you ask for a lawyer”

A policeman from Maskouski district police department in Brest Yauhen Bury has used unacceptable actions in his work.

Such a statement has been made in the complaint to the Office of Prosecutor General by a mother of a 12-year-old girl from Brest, A.I.

“First time he visited our house and told the elder sister that he wants to communicate with “the suspect, against whom a criminal case had been opened,” face-to-face, “Viasna” human rights centre informs.

If she won’t confess she had stolen a mobile phone from her underage acquaintance, or she had found it, he was going to “put her to shame” for the entire school. And he did so. He came to the school while the girl was having lessons, and after a talk with a teacher, he invited the girl in a different room, and interrogated the girl in presence of the teacher. The teacher didn’t defend the schoolgirl from the illegal actions of the policeman. The law enforcer had not allowed the girl to phone her parents or a lawyer, with whom her mother had signed an agreement, and the girl had a visit card. The policeman simply stated: “Now it’s all clear. You are guilty, as you demand a lawyer.” The girl was taken bad at home, she fell unconscious, and an ambulance was called in.

The mother of the girl is sure that the policemen abused his authority. In her appeal he asks to open a criminal case against the policeman on charges relating Article 426 Part 3 of the Criminal Code (abuse of authority). She also asks to reproach the head of Maskouski district police department that such actions by policemen towards underage are inadmissible in the future.

A human rights activist Raman Kislyak believes such actions of a criminal police officer are unacceptable. The rights of the underage person and guarantees of defence are obvious. A thorough investigation should be carried out, so that such facts would not repeat in the future, Raman Kislyak believes.
