With support of REP trade union saleswoman won a lawsuit against employer

Luninets Court ordered that the entrepreneur is to pay the salary to Alena Dubanosava (Elena Dubonosova), who had been fired.

The decision of the court was announced about a month ago. We remind that in the end of May Alena Dubanosava, the wife of the activist of the Independent trade union Leanid Dubanosau, sacked from “Granit” factory, was dismissed from the private perfume store “Krasavitsa” (Beauty), where she worked as a saleswoman, praca-by.info informs.

Her employer, Alyaksei Katsuba, a businessman, fired her for “committing wrongful actions.”

Alena Dubanosava didn’t agree to such a formulation and filed a claim demanding her reinstatement. Later, she changed her claim. In particular, she demanded from the court to declare her dismissal illegal, oblige the employer-defendant to change the wording of her dismissal for “by mutual agreement”, and to collect from the employer her non-received salary for December 2013 – April 2014.

The ruling of the court is commented by Alena’s husband, Leanid Dubanosau.

- The court ordered the employer to pay the salary for April only (1 mln 300 thousand), as by that time the three-months term’s deadline for filing a statement of claim related to paying salary for the previous period had passed. Alena dropped the demand to reinstate her in her job, as it became clear that her previous employer was a pinchpenny, and it does not promise any good for employees.

As long as Alena had already started her work in another shop, we didn’t demand to change the formulation of the reason for her dismissal. The REP trade union should be thanked for the court’s taking our side. Their support and advice of the trade union’s legal inspector Uladzimir Malei helped us a lot, as we hadn’t been aware of our rights. The leader of the trade union Henadz Fyadynich called us all the time, asked about the news, and we a very grateful for that, -- Leanid Dubanosau said.

We remind that after Alena Dubanosava filed a lawsuit against the businessman, Alyaksei Katsuba, on his motion a criminal action was opened against her on charges relating Article 14 Part 1 (attempted crime) and Article 257 Part 2 (consumer fraud) of the Criminal Code of Belarus.

It was stated in the charges that Alena Dubanosava wrote up the price of goods.

- At the moment the criminal case is suspended. Alena cannot be charged with anything. On the contrary, as far as I know, the investigation is carrying out a check of the employer now. He charged my wife with deficiency, as he didn’t want to pay salary to her, -- Leanid Dubanosau added.
