Vladislav Baumgertner’s house arrest stays valid

On 17 February the Moscow City Court held valid the ruling to extend the term of the house arrest for Uralkali ex-head Vladislav Baumgertner.

Thus, the defense’s petition of appeal was dismissed.

The 16 January ruling issued by the Basmanny court of Moscow to extend the house arrest term by 2 months and 25 days or up till 14 April was upheld, while the appeal was dismissed, the new court ruling reads.

The appeal requested a change of the pretrial restriction measure or softer house arrest terms.

In turn, the prosecution insisted that the graveness of the accusations Vladislav Baumgertner faces must be taken into account since the punishment for such crimes envisages imprisonment for more than three years.

Vladislav Baumgertner was arrested in Minsk at the end of summer 2013. On 20 November the Office of the Prosecutor General of Belarus authorized the extradition of Vladislav Baumgertner to Russia where he faced charges specified by part 3, article 33 and part 2, article 201 of the Criminal Code of the Russian Federation, namely misuse of authority. The investigation team believes that while discharging his managerial functions in commercial organizations, the accused abused his authority, used it against legal interests of these organizations and for the sake of profits and advantages for third persons. The actions resulted in substantial damage and grave consequences for Belarusian Potash Company and Belaruskali.

On 10 December Vladislav Baumgertner was placed under house arrest upon the request of the investigation team. He was forbidden to leave the place of residence without permission of the investigation, talk to anyone but immediate relatives, the lawyer, and the investigators. He was forbidden to receive guests. Apart from that, he cannot use any communication systems, including phones and Internet access. Before 10 December Vladislav Baumgertner was kept in a Moscow pre-trial detention center.
