The decision was taken by judge Stanislau Pivavar.

It became known on May 15, when activist Uladzimir Hundar received a copy of the court decision of May 8 signed by deputy chair of the court Vasily Petryu. The letter says that as the court decision of March 21 in Uladzimir Hundar's administrative case came into force, the “physical evidence – the national flag of Ukraine and a poster with the text 'Putin's aggressors, get out of Ukraine! Get out of Belarus!' should be destroyed”. Hundar held a one-man picket in Baranavichy on March 4 against a war between Russia and Ukraine, Viasna human rights centre reports.

Uladzimir Hundar, with a Ukrainian flag on his shoulders, raised a poster in the city centre. The picket lasted for 10 minutes. A court found him guilty of organising and holding an unsanctioned mass event (part 2 of article 23.34 of the Code of Administrative Offences) and fined him 15 penalty units. Judge Stanislau Pivavar refused to return the Ukrainian flag and the poster to Uladzimir Hundar saying the physical evidence should be attached to the case.

The court has decided that the physical evidence should be destroyed. The decision of the court cannot be appealed against.

“When we were marking the 90th anniversary of the Belarusian People's Republic in Baranavichy on March 25, 2008, the police seized five white-red-white flags, but returned them later after a trial. I am ashamed of the court, which insulted the state symbols of fraternal Ukraine,” Uladzimir Hundar said.
