A tenant miscalculated the size of severance pay and violated the procedures, when laying off the employees.

A number of legislation violations on the part of the administration of the former Republican Unitary Enterprise “Slonimskaye Housing Repairs and Utilities Association,” recently converted to “Slonimskaye housing and utility sector,” got found out in the process of considering the case on the claim for recruitment.

The trade union lawyer said that during the pre-trial meeting, which was held on the claim of watchmen Natallia Pradko and Sviatlana Sashko in the Slonim district court on 20 September, it became clear that the employer had miscalculated the size of severance pay and violated the law. Moreover, as it turned out, the collective agreement, aimed at protecting the rights of workers, is more like the employer's charter of immunity.

– The administration did not provide the workers with a list of available vacant places, as it is required by the legislation, which they could occupy for health reasons. In addition, the workers had never been showed the collective agreement concluded by the trade union of workers of light industry, a member of the Federation of the Belarusian Trade Unions.

Though, the watchman appealed to the administration with such a request. Natallia Pradko paid contributions to the trade union. It appeared in court that all the articles of the collective agreement, which could be invoked in the protection of workers, have an advisory nature.

This is not surprising, because the director is a member of the union himself, and his deputy is the chairman of the trade union committee. In addition, the administration had to warn all the employees, who were laid off, in three months and gave them an additional day off a week to find a new job during this time. These requirements were also ignored, – Yury Beliakou said.

The union believes that the employer committed serious violations, when laying off the watchmen, and calls for their re-entry, and the allocation of severance pay.

The next meeting will be held on Tuesday, 27 September.
