Homiel Prosecutor’s Office Warns Reporter

On February 13 correspondent of the “Belorusskaya Delovaya Gazeta” in Homiel region Iryna Makavetskaya was summoned to the regional prosecutor’s office. The head of the department of general supervision over lawful service of legal Alyaksandr Eliseew read a text of official warning issued by prosecutor general of the region Aleh Palavinka.

The cause for issuing the warning was the article by Iryna Makavetskaya “Viscount” Does Not Blend With Belarusian Reality” which was published on December 10, 2003. The Prosecutor asserts that by this piece of writing the journalist had violated Article 5 of the Law on Mass media and Article 9 of the Law “On Legal Proceedings and Status of Judges in the Republic of Belarus”. The prosecutor asserts that Iryna Makavetskaya “published a material of a legal case without written permission of the judge and called into question his independence and lawfulness of the court decision on the case of BST Ltd. bankruptcy”. The prosecutor warned the reporter that in case of further violations of the law Iryna Makavetskaya could be called to account and sued”.

It is worth mentioning that the Ministry of Information issued an official warning to the editorial office of the newspaper for this article. Minister Uladzimir Rusakevich considers that the newspaper violated Article 5 of the law on Press, by publishing materials of the case without permission of the judge. The editorial office of the newspaper plans to appeal this decision in the Supreme Economic Court.
