New Administrative Code Provides for Administrative Arrest for 25 Days 16:16, 26/02/2007
As “Vechernij Brest” has been informed by the head of legislative execution and legality control department of regional procuracy, counsellor of justice Alyaksandr Kulich, the new Code on Administrative violations provides for a maximal penalty of 25 days of administrative arrest. Earlier the maximum term was 15 days. Many judges are uninformed about that still, as the texts of the new codes have just been received by them, though they are to come into force in a few days.
The new provisions previously formalised in decrees of the president, the Council of Ministers, have been include into the new Administrative Code. All grounds for administrative responsibility previously found in different documents are put into one book now, which would make the work of law-enforcing agencies easier. One should note that the form of the new Administrative Code is copied from the Criminal Code, and many notions of a criminal law are added into it.
In particular, “an attempt to commit an administrative violation” is one of the novelties. For instance, an attempted illegal physical flow of inventory through customs border of the country is mentioned. Earlier it was hard to speak about intention in case the deed hadn’t been completed, and now they can speak about an intention. It is worth mentioning that the term of the administrative arrest under the new code could reach 25 days instead of 15 days under the previous code.
