Belarus and Iran to conclude Agreement on Legal Assistance :: Charter'97 :: News

The standing commission on international affairs and relations with the C.I.S of the “house of representatives” intends to recommend the agreement on legal assistance in civil and criminal lawsuits between Belarus and Iran for ratification. The decision was made today at the sitting of the commission. The “deputies” are to consider the document at the session 4 May.

According to deputy minister of justice of Belarus Alyaksandr Simanau international agreements on legal assistance entitle our citizens to get the same legal defense in terms of personal property as well as non-property rights as citizens of the foreign state get. At the present moment agreements on legal assistance have been concluded by Belarus with the C.I.S countries as well as with China, India, Poland, Cuba, Lithuania, Hungary, Czech Republic. The conclusion of such agreement with Turkey, the SAR, Lebanon and Egypt is under way.

The Belarusian- Iranian agreement on legal assistance in civil and criminal lawsuits was signed in Teheran in 2006. Its main aim is creation of the legal background for defense of rights and legitimate interests of individuals and legal entities of Belarus and Iran. According to the document Belarusian nationals are entitled to appeal directly to bodies of justice of Iran which jurisdiction lies with civil and criminal lawsuits, including courts, public prosecutor’s office, notary offices, to lodge claims, to initiate appeals and make other procedural actions under the same conditions as nationals of Iran. Similar authorities are provided for legal entities, Alyaksandr Simanau added.

Cooperation between Belarus and Iran in the framework of this agreement will be implemented through central bodies. Among those in our country are the ministry of justice, higher economic court, public prosecutor’s office, and the Supreme Court, the deputy minister of justice of Belarus reported.
