10 July in the course of the trial on Kanstantsin Lukashou’s case victimized militiaman Anatol Suschenya refused his material claims against Lukashou. That was reported to BelaPAN by
K. Lukashou’s brotherVyachaslau Siuchik. According to him, the refusal was declared by Anatol Suschenya during the trial on 10 July.
It is to be mentioned that K. Lukashou was detained 19 December 2006.He was charged of striking the militiamen by car when taking his brother Vyachaslau Siuchik from the surgery department of the Minsk third hospital. That day unidentified persons with militiamen’s I.D.s made an attempt to detain Siuchik after his discharge from the hospital for the supposed minor public disorder. But with his brother’s help the policymaker managed to escape.
20 February 2007 K. Lukashou was confirmed guilty of the crime in compliance with Article 364 of the Criminal Code of Belarus (violence against militiaman on duty.)He was sentenced to two years on probation with a two- year suspension of the sentence. The court also made a judgment to charge Br 1 million from K. Lukashou in favor of militiaman for compensation of his moral and physical damage. But 3 April the panel of judges of the Minsk city court annulled the Leninsky district court judgment handed down on 20 February due to the lawyer’s appeal. The defense considers that there is no corpus delich in Lukashou‘s actions. The case was sent for reexamination.
10 July the Leninsky district court listened to the testimony of the witnesses who hadn’t appeared at the court the day before. The public prosecutor and lawyer also made their speeches in the court. ”The prosecutor asked the court to retain the previous judgment, i.e. two years on probation, valid on the ground that there were no reasons for not trusting the victimized A. Suschenya. Lukashou’s lawyer Valyantsina Shikhantsova on the contrary considers that in compliance with the witnesses’ evidences there is no corpus delich in Lukashou‘s actions and due to the above mentioned demands his total justification”, A. Siuchik reported.
