General Prosecutor's Office has refused to extradite Bakiyev's brother

General Prosecutor's Office of Belarus leaves unsatisfied the extradition request of Zhanybek Bakiyev to Kyrgyzstan.

"Taking into account the events accured in the Kyrgyz Republic and the nature of the charges, imposed to Zh.Bakiev Belarusian side believes that the request for extradition is connected to harassment on the basis of his political beliefs, so the extradition request of the General Prosecutor's Office of the Kyrgyz Republic about Zh.Bakieva has been leaved dismissed", - told to "Interfax-West" in the General Prosecutor's Office of Belarus on Wednesday.

It was noted there that in June of this year General Prosecutor's Office has already considered a request of the General Prosecutor's Office of Kyrgyzstan about Zhanybek Bakiyev's extradition for criminal prosecution.

"In accordance with subparagraph e) of paragraph 1 of Article 89 of the Convention on legal assistance and legal relations in civil, family and criminal cases from October 7, 2002, extradition cannot be performed if there are reasonable grounds to believe that an extradition request is related to the prosecution of a person on the grounds of race, gender, religion, ethnic origin or political opinion", - stressed at the prosecutor's office.

"Interfax-West" also was informed that such position of the General Prosecutor's Office of Belarus was brought, in the prescribed manner, to the attention of the General Prosecutor's Office of the Kyrgyz Republic in June of this year.

"Kyrgyzstan should take a more robust position in the situation with Bakiyev family, for otherwise it will be difficult for Bishkek to prove that it has constructive aspirations on the way to the Customs Union", - said a source in government circles of Belarus on Wednesday.

"The Kyrgyz side has a clear idea of the position on the Bakiyev’s question" - he said. The interlocutor of the agency said that "the situation - this is not the worst way out for the current authorities of Kyrgyzstan". "The Belarusian side has much more inconvenience", - said the source in Minsk.

As the website charter97.org reported previously, Pictures of  Zhanybek Bakiyev, strolling in the center of Minsk on August 17, have been posted in social network “Facebook”.

Pictures caused an international scandal. On August 21, the Ministry of Foreign Affairs of the Kyrgyz Republic, adressed to the MIA of Belarus a verbal note "to adopt comprehensive measures to expedite the arrest of a citizen Zhanybek Salievich Bakiyev and his subsequent extradition to the Kyrgyz Republic." Without waiting for response to the demands, on August 24 the Ministry of Foreign Affairs of Kyrgyzstan withdrew its Ambassador in Belarus, Eric Asanaliev, for consultations.

Former ruler of Kyrgyzstan Kurmanbek Bakiyev and his brother Zhanybek Bakiyev were included in the international wanted of the CIS and in the international wanted list by Interpol. They are charged under the Criminal Code of complicity in mass murder. The Kyrgyz ex-ruler is hiding with his family in Belarus since April 2010. Back in August 2010, Kurmanbek Bakiyev, has received a passport of Belarusian citixens, and this year he bought a house for $ 2 million on the outskirts of Minsk.
